HOMEOWNERS ASSOCIATION – HOUSE RULES SUNSET HILL

The Developers have prepared this set of rules for the benefit of new and established residents designed to ensure that all residents enjoy the lifestyle offered and to encourage them to respect the interests and welfare of all who live here. Owners must, as soon as possible, set up their Homeowners Association and committee and operate the complex in accordance with these rules until amended by the elected committee members.

The Initial monthly Levy is set at €50.00 per month 

1          General

1.1               The Rules of the Association shall be binding on all owners and all persons occupying any unit. They, in turn, shall be responsible for ensuring that members of their families, tenants, visitors and domestic cleaners comply with them. 

1.2              Owners who let their units shall incorporate these Rules into their rental agreements 

2                    Security

2.1        Entry and Exit: Visitors, Domestic Cleaners, Contractors – Residents shall be responsible for the access and departure of all visitors, domestic cleaning help/staff, including gardeners, contractors and the like. 

2.2        Any problems encountered with any security issue should be reported to the Homeowners Association. 

3          Buying and Selling

3.1               An owner shall notify the Homeowners Association in writing that a purchase or sale is contemplated. 

3.2               One sign for each estate agent, that does not infringe the safety of traffic entering or leaving the complex, may be placed outside the entrance gate to the complex and a further sign may be placed outside the unit being bought or sold. All signs shall be removed within two weeks of the purchase or sale. 

3.3               Estate agents will be allowed access to the complex only on express permission of the owner. Normal entry and exit rule will apply. 

3.4               Before a property transfer can take place, a clearance certificate confirming that levies have been paid up to date shall be obtained from the Homeowners Association. 

4                    Building Alterations 

4.1               No owner shall, or shall allow a tenant to:

4.1.1          Erect any fencing, walling or paving on the land in the complex without having first obtained written approval from the Homeowners Association.

4.1.2          Install on any building or structure, television aerials, radio aerials or similar structures, or solar heating panels that are exposed to view without first obtaining written approval from the Homeowners Association.

4.1.3          Make any additions or extensions to any building on the property, or erect upon the property any further building or structure, without having first obtained written approval from the Homeowners Association. 

4.2               In considering requests of the above nature, the Homeowners Association shall not unreasonably withhold approval unless the Association are of the opinion that such additions, extensions or alterations are inconsistent with or impinges on the aesthetic appearance of the complex. 

4.3               The Homeowners Association has the power to require that any construction work in the complex shall be supervised to ensure that the provisions of these rules are complied with and that all work is performed in a proper and workmanlike manner. 

4.4               No owner shall carry out any construction of any additional structure or any additions or alterations until having submitted plans to the relevant Council and unless the plans have been approved.

5          Property Maintenance

5.1               To ensure that the value of all owners’ property will not be impaired, residents shall maintain their properties and the sidewalk adjacent to their properties in keeping with the generally high standards set in the complex. 

5.2               The Homeowners Association have the power to give written notice to any owner to perform maintenance on their property and if such request is not complied with, the Association may attend to such maintenance at the cost of the defaulting owner. 

6          Speed Limit

6.1               The speed limit within the complex is 20 kilometres per hour; and residents and visitors shall be mindful of children playing in the road. 

6.2               Residents shall be responsible for their visitors and contractors complying with the speed limit to ensure safety of all residents and their properties. 

7          Parking

7.1               Parking inside and outside the complex shall be at the risk of the residents and their visitors. 

7.2               Residents shall be considerate of others with their own parking and those of their visitors. Parking shall be in such a manner that it does not inconvenience other road users nor should it compromise the free flow of vehicles within the roadway. 

8          Refuse
            Residents shall dispose of their refuse in the bins as provided for by the municipality outside the complex. No refuse is to be left outside units. 

9                    Pets

          Residents are permitted to keep domestic animals and shall, where appropriate, confine their animals to their properties to prevent them from wandering 
          unattended in the complex. No commercial breeding shall be conducted within the complex.

10        Noise

           In consideration of their neighbours’ well being, residents shall ensure that they, their visitors, domestic cleaners, and/or contractors do not make undue
           noise. 

11                Enforcement of Rules

11.1            The decision of the Homeowners Association shall be binding on the interpretation of the Rules. 

11.2            In the event of annoyance, aggravation or complaints arising between owners or occupants the parties concerned must first try and reach settlement. This should be done with consideration and tolerance. Only when problems cannot be resolved between such parties, should they be referred to the Homeowners Association in writing. 

11.3            To enforce any of the rules of the Homeowners Association, the Association may:

11.3.1      Give notice to the owner concerned to remedy such breach within a period determined by the Association

11.3.2      Take such steps as the Association may consider necessary to remedy the breach of the rule by the owner, and debit the cost of so doing to the owner, which amount shall be deemed to be a debt owing by the owner to the Association, or

11.3.3      Take such other action, including proceedings in court, as the Association may deem fit. 

Happy and satisfying community living is achieved when residents use and enjoy their units and common property in such a way that they show respect for the rights of others. Compliance with the Rules and general consideration by residents for each other will help in creating a happy community.
